One of the more interesting NFT-related lawsuits seen in the last few years has been that of Hermes versus Mason Rothschild, a man who created an NFT collection called MetaBirkins. These NFTs featured the likeness of Hermes’ iconic Birkin bag and the French label took him to court for trademark infringement. However, despite Rothschild’s insistence that his work was protected, a jury has ruled that they constitute an infringement of trademark.
Down But Not Out
In the ruling, it was decided that not only is Rothschild to cease selling NFTs with the fashion house’s Birkin bags but he also had to pay damages. He is facing a $110,000 fine for intellectual property infringement and another $23,000 fine for domain squatting.
According to Hermes, Rothschild had been planning to create a dedicated site for his NFTs as well as a program to let customers ‘build’ their own digital Birkins. However, while his initial endeavor was successful, bringing in about $125,000 by his account, he was eventually issued a cease-and-desist letter from Hermes.
Not willing to back down, the case was taken to court where Rothschild lost. Taking to Twitter after the ruling, he said, “What happened today was wrong. What happened today will continue to happen if we don’t continue to fight. This is far from over.”
